Employer-sponsored wellness programs that collect health information will need to provide an ADA notice. Employers have the options to craft their own version instead of using the EEOC sample letter. However, employers will need to make sure their version of the notice contains all required information. One very important aspect to note is that a HIPPA notice that employees on a wellness program receive, may not fully cover what this new document must state. The document must have a notice that informs employees what information will be collected, who will receive it, how it will be used, and how it will be kept confidential. The ADA notice requirement takes effect for the plan year 2017.
